Federal High Court nullifies direct and indirect primaries of Rivers State APC

States that Rivers State APC can not provide any candidate for the Governorship, Senate, House of Representatives and House of Assembly elections.

A Federal High Court in Port Harcourt on Monday restrains the Independent National Electoral Commission (INEC) from identifying any candidate of the All Progressives Congress (APC) for the 2019 General elections in Rivers State. The court likewise nullified all elections of the APC in Rivers State for the upcoming elections in 2019.

The court ruled particularly that the APC can not take part in the Governorship, Senate, House of Representatives and House of Assembly elections throughout the 2019 election in Rivers State.

Justice Kolawole Omotosho in his judgment in the suit submitted by Senator Magnus Abe and others versus Rivers State APC and others stated the APC for refusing to obey court orders should bear the effects of her disobedience of the law.

Justice Omotosho mentioned that the Indirect and direct primaries of the Rivers State APC are prohibited, null and void. The court went further to state that both the Direct and indirect primaries were held during the pendancy of the suit at the Rivers State High Court. According to the court, the APC performed the indirect primaries in gross disrespect of the pending suit prior to Justice Chinwendu Nwogu of the Rivers State High Court.

He kept in mind that the judgment of Justice Chinwendu Nwogu nullifying the primaries of the APC in Rivers State is yet to be put aside by an appellate court, for this reason it stays valid. The court, for that reason held that the names sent out by the Amaechi faction and the National Working Committee of the APC to INEC for the 2019 General elections were illegal and need to be disregarded.

Can this be true that Rivers APC has no Governorship Candidate?

He also lashed out at Senator Abe’s faction,  that the Direct primaries performed by the Senator Magnus Abe faction were unlawful due to the fact that the National Working Committee of APC did not take part or keep an eye on the processes.

Justice Omotosho included that Justice Chinwendu Nwogu was clear when he nullified all congresses and primaries held throughout the pendancy of the suit, that included the Direct primaries performed by the Abe faction. He stated that both the Senator Magnus Abe and the Amaechi factions have no leg to stand in view of the judgment, thus both factions are disqualified from taking part in the elections. The court held that the APC in Rivers State has no power to choose and sponsor any candidate for the 2019 General elections.

Rivers State APC is yet to comment on the court ruling and to say whether they will appeal the judgement.
